Terms of Service

§1 Acceptance of Terms
By accessing or using Simcha Days you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, please do not use the service.
§2 Permitted Use
Simcha Days is a private, invite-only family calendar service. You may use it to coordinate weddings, bar and bat mitzvahs, engagements, and other Jewish family milestones. All use must be lawful and in good faith.
§3 No Illegal Activity
You may not use Simcha Days for any unlawful purpose, including but not limited to:
- Harassment, fraud, or impersonation of any person or entity
- Transmitting or storing content that violates any applicable law
- Attempting to gain unauthorized access to any account, server, or network
- Interfering with or disrupting the platform or its infrastructure
- Violating the privacy or rights of other users or third parties
We reserve the right to suspend or terminate any account we reasonably believe is engaged in unlawful activity, without notice.
§4 Intellectual Property
All original aspects of Simcha Days, including but not limited to its calendar system, conflict-detection logic, family-branch model, user interface design, branding, and underlying software, are proprietary and protected intellectual property of Simcha Days.
You may not copy, reproduce, reverse-engineer, adapt, re-publish, resell, or create derivative works based on any part of the platform without prior written permission.
The Torah prohibition of הסגת גבול, "do not encroach upon the boundary of your neighbor" (Devarim 19:14), is not limited to physical property. The poskim extend this principle to matters of livelihood and intellectual creation. The Bava Basra (21b) and many Rishonim and Acharonim recognize that appropriating another's original work, business concept, or creative effort in order to profit or compete constitutes a transgression of this prohibition, as it encroaches on the domain that another person has established through their effort and investment.
In practical terms: replicating the design, functionality, or concepts of Simcha Days in a competing or derivative product, even without technically violating secular copyright, may constitute an issur d'Oraisa. We take this seriously and expect users and any parties who come into contact with our platform to do the same.
This protection applies alongside and in addition to applicable civil copyright, trade secret, and unfair competition law.
§5 User Content
Content you and your family members enter into Simcha Days (event details, names, dates, uploaded files) remains yours. You grant us a limited license to store and process that content solely for the purpose of operating the service. We will never use your content for advertising or share it with third parties for commercial purposes.
§6 Account Responsibility & No Sharing
You are responsible for maintaining the security of your account and for all activity that occurs under it. Notify us immediately at hello@simchadays.com if you suspect unauthorized access.
Accounts are personal and non-transferable. Each Simcha Days account is issued to a single named individual and may not be shared with, transferred to, or used by any other person. Sharing login credentials — including Google account access — with another party is strictly prohibited, regardless of the reason. Each user who accesses the platform must have their own approved account. Violations may result in immediate suspension or termination of the account without refund.
§7 Service Availability
We work hard to keep Simcha Days available and reliable, but we do not guarantee uninterrupted access. We may update, maintain, or temporarily suspend the service with or without notice.
§8 Limitation of Liability
Simcha Days is provided "as is." To the extent permitted by law, we are not liable for any indirect, incidental, or consequential damages arising from your use of the service, including scheduling conflicts or missed events.
§9 Changes to These Terms
We may update these terms from time to time. When we do, we will update the date above. Continued use of Simcha Days after a change constitutes acceptance of the revised terms.
